As you begin the immigration process, the USCIS will send you a Notice of Action—Form I-797. This form indicates that the USCIS has received or approved a petition or form filed on your behalf. If you are seeking immigration through your employment or certain family members, your Form I-797 will show a priority date on the second line of the form.

By law, the United States can only grant a certain number of immigrant visas for each fiscal year. The yearly employment-based visa total is currently 140,000, although this can be adjusted for unused visa slots from the prior year. The employment-based visa total is divided into several categories of preference as well as by countries of origin, each receiving a percentage of visas to be granted that year.

When one of these categories has more applicants than available visas, the applicants must form a visa queue. The priority date marks your place in that queue. It indicates the day on which your labor certification application or petition was accepted for processing. According to the Department of State (DOS), the priority date determines your “turn” to apply for an immigrant visa.

How Do You Use Your Priority Date?

The DOS publishes a Visa Bulletin online. Every month, the Visa Bulletin shows two charts for each sponsorship category of immigration visa. Here is a partial example of a recent chart from the Bulletin:

The first column lists preference categories for employment visas. To consult this chart, you would find your own preference category, then check the second column. “Chargeability” refers to your country of origin as determined by US law for immigration purposes. If yours is one of the countries or regions listed to the right, you would consult that column; otherwise, you would consult the second.

The letter “C” indicates that the visa category in that row and column is current—that is, there is no visa queue to wait in, and applications may be filed now. But if there is a date, then there is a queue, and you must consult your priority date from your I-797. If your priority date is earlier than the date listed for your category and chargeability area, you are eligible to make a filing.

However, there are two charts of this type in the bulletin, one headed FINAL ACTION DATES and the next headed DATES FOR FILING. What does this mean?

How Do You Know Which Dates Apply to You?

The Final Action Dates chart shows when visas are currently available. If you are eligible under the Final Action Dates chart, you may file for lawful permanent residency (LPR), the green card. The Dates for Filing chart has a different meaning, depending on the time of year and the type of immigration processing you are using.

Those undergoing consular processing who are eligible according to the Dates for Filing chart will receive further instructions from the National Visa Center (NVC) for their application and interview. They will then be able to assemble the documentation they need for their green card application and prepare for their interview with the NVC.

USCIS will sometimes instruct those in the adjustment of status process to use the Dates of Filing chart instead of the Final Action Dates chart for their petitions. They do this when there are more visas available for the current fiscal year than there are applicants, so it generally occurs in the first few months of the fiscal year. That information is updated each month on the USCIS Visa Bulletin web page, which nonetheless notes: “[If] a particular immigrant visa category is ‘current’ on the Final Action Dates chart or the cutoff date on the Final Action Dates chart is later than the date on the Dates for Filing chart, applicants in that immigrant visa category may file using the Final Action Dates chart during that month.”

When Are You Allowed to Return to the United States of America After You’ve Been Deported?

Many individuals and their families around the world come to the United States of America with hopes and dreams of starting a new life in this country. The U.S. has long prided itself in welcoming immigrants. Our beacon of the American Dream, the Statue of Liberty, states Emma Lazarus’s 1883 poem, “Give me your tired, your poor, your huddled masses yearning to breathe free.” And, for many immigrants, this land does represent opportunity and a fresh start.

Yet, the U.S. can seem unforgiving to immigration hopefuls arriving at its borders and shores. Whether you read stories of ICE detention camps or the statistics for forceful deportations, many of those who come to America looking for a better life are struck by the harsh realities of a flawed, frustrating, restrictive, less forgiving, and sometimes cruel immigration system.

Once the U.S. government has deported or summarily removed individuals, loved ones may face a mandatory waiting period before they are allowed just to file for permission to re-enter into the country. Some may be indefinitely or permanently barred from lawful admission. During this time, they may live wherever they can, but they cannot cross the border into the United States. Otherwise, they can risk more harsh and indefinite penalties.

Each individual’s specific waiting period depends upon their particular circumstances. The shortest waiting period is often five years, the most common is ten years, some may face 20 years, and others may even be subject to an indefinite or even permanent removal from the U.S. Some may complete voluntary departure at a U.S. consulate or embassy, but may still have to wait to file for waivers sometimes referred to as pardons.

Which Deportees, that is Aliens or Respondents, Face a Five-Year Ban from the U.S.?

Those who arrived in the U.S. at an official port of entry but were removed because they were deemed to be ‘inadmissible’ for not having the correct visa ‘may’ be hit with a five-year ban from the country. Other reasons for a five-year ban include those who have undergone official removal proceedings after entering the U.S. without a visa. Also, some of those who file for asylum, in good faith, but fail to complete the voluntary departure process. Some who fail to appear at immigration court hearings or depart those hearings prematurely may receive a five-year ban. There may be financial penalties imposed for not departing, as well.

Who Might Face a Ten-Year Ban from Returning to the U.S.?

Ten-year bans are typically reserved for those who an immigration judge orders the deportation of in court, regardless of whether the respondent appeared in court or not. Ten-year bans are the most common for deportees, who are called “respondents” in Immigration Court.

What Could a Deportee Have Done to Be Punished with a Twenty-Year Ban from the U.S.?

20-year bans are an extreme reserved only for those who commit extra wrongs in the eyes of the law. If an immigrant is removed from the U.S. and does not wait out the entirety of their ban, they may receive a 20-year ban from the country as a penalty for reentering the country too early. If you have received other orders of removal in the past, your next deportation order could come with a 20-year ban. Additionally, you may be barred from reentry into the U.S. for 20 years if you were convicted of a felony during your time in the U.S.

Is an Indefinite Ban a Possibility?

Indefinite bans are reserved for those who make material misrepresentations of fact. That is, a person lied to a DHS Official, such as a CBP or USCIS Officer, which is considered a tribunal. A tribunal hearing is considered to be a consular interview, port of entry, pre-board inspection, U.S.C.I.S. interview, or other stop where a person is considered to be under oath to tell the truth. There is a waiver of the indefinite bar on admission. However, the application must not only be filed, the U.S.C.I.S. must agree that a U.S. citizen or lawful permanent resident spouse or parent will suffer extreme hardship as a matter of law and discretion. A balancing test of the applicant’s equities ‘may also be’ a consideration in the decision. If a waiver is not approved, then the ban remains.

Is Permanent Removal a Possibility?

You could be removed from the U.S. and permanently banned from returning. While an aggravated felony conviction could result in a 20-year ban from the U.S., it could just as easily result in a permanent ban. Permanent removals are also struck down on those who illegally reenter the U.S. within a year of their deportation.

What Are Your Legal Options for Returning to the U.S. After Forceful Deportation?

You must respect your deportation order and not attempt to reenter the U.S. before your ban period is complete. However, that does not mean that you need to sit on your hands and do nothing while waiting for the ban to expire. Various options are available to you, depending on the length of your deportation orders.

It’s not easy to overturn or reverse deportation orders. The official removal of an individual from the U.S. will follow them, delay, and hurt their chances of reapplying for entry into the country. In many cases, attempts to reenter the U.S. require starting over the application process from square one with a minimum ten year wait upon leaving.

Your first step should be to file a well documented Form I-212, a waiver that may legally forgive your removal, thus allowing you to eventually reenter the country with a visa. This waiver is typically only granted to those who were deemed inadmissible at the time of their original entry or to those who voluntarily left the country after being threatened with removal. Those with felony convictions are unable to successfully seek a Form I-212.

While the I-212 is all important, there is other permission that you need. An applicant for admission usually requires some form of visa sponsorship in order to be eligible to apply for a green card or visa.

Before taking any of these steps, it is crucial that you speak with a legal professional for guidance. Filing an application before you are allowed to do so may be a waste of time, money, or, worse, it may actually reflect poorly on your chances and create confusion. Who Qualifies for a Fiancé Visa?

To qualify for a fiancé visa, you must:

• Prove that the relationship is authentic by providing photos, correspondence, or written statements from people who know you as a couple.
• Prove that you have met your partner in person at least once in the last two years unless you waive this requirement for religious reasons.
• Agree to marry your partner within 90 days of entering the U.S.

What Does a Marriage Visa Do?

A marriage visa does not allow unmarried partners to enter the United States. It is for a married couple who were already married outside of U.S. territories. This type of visa allows a foreign spouse to enter and work in the United States. A successful application for a marriage visa can result in a green card, which could eventually lead to citizenship.

Some qualifications for a marriage visa are:

• Provide proof of marriage, such as a marriage certificate showing both spouses’ names and the marriage date.
• Provide further evidence that you have a good faith relationship before marriage, such as correspondence, travel together, joint living arrangements, and other documentation tending to verify that the marriage is based on moral respect.

The U.S.C.I.S. is one agency, with primary responsibility to ensure that employers do not hire foreigners, who are unauthorized to work. The U.S.C.I.S. and the Social Security Administration, like the I.R.S., conduct “audits” to determine whether an employer knowingly, negligently or recklessly violated immigration laws. The civil and criminal penalties can devastate a business and its employees. The U.S.C.I.S. may seem random and unpredictable in its enforcement. However, the Agency depends upon what it considers reliable leads.
Many employers hire attorneys to conduct I-9 self-audits and policy reviews. Employers can hire attorneys before the search warrant can begin if they insist. An employer can ask for three days to hire counsel or indicate that they have an attorney. Many employers do not know all obligations and responsibilities, which can create unexpected penalties. It also conducts training sessions for personnel departments with in-house examples following a self audit. Our office explains how an actual U.S.C.I.S. audit will generally take place and what will be requested by the U.S.C.I.S. Employers can ill-afford to be unprepared for an I-9 audit. The cumulative fines were not capped by Congress. However, there are also potential criminal penalties, as well. The fact that this starts as a U.S.C.I.S. civil investigation means that it is easier for people to admit to crimes during an audit.

Some foreigners are authorized to work, but a company’s personnel department often does not understand, which of numerous U.S.C.I.S. documents, stamps and identification cards allow a foreigner to lawfully work in the United States. Often, personnel departments mistake fraudulent documents for the original U.S.C.I.S. documents. These mistakes can be costly to an employer. In fact, some employers have turned away individuals qualified to work.

The Immigration Act of 1986 mandates that all employers verify the resident and work authorization status of all its workers, before it hires a worker. All workers, including those who appear to be U.S. born must document their resident status as a citizen, resident or work visa holder.

Some workers are exempt from this procedure, but all hires and re-hires after 1986 are not exempt. Employers must ask for government issued identification to verify a worker’s resident and/or citizenship status. Some older forms of U.S.C.I.S. documents are no longer valid for such verification purposes.

The penalties for improperly documenting a worker, U.S. born or foreign born, range from $100 to $10,000 per violation on the civil penalty side. There are also criminal penalties for members of personnel departments under certain circumstances.

A violation can consist of one relevant mistake on an I-9 form. A “pattern and practice” of ignoring the material I-9 form requirements can result in federal indictments and criminal convictions for the employees responsible for preparing the forms. Supervisors of such responsible employees also can face the same criminal problems.

A book is available from the U.S.C.I.S. known as an M-274. This book documents some, but not all, of the documents accepted for I-9 employee verification. I find that the book lacks enough information to allow an employer to make decisions.

The U.S.C.I.S., in October of 1997, now provides a pilot program for some employers called eVerify. The program has its weaknesses, which includes a lack of information on validly issued employment authorizations cards. Some U.S. citizens have been excluded from the database, as well. Such shortcomings can lead to unnecessarily deferrals to U.S.C.I.S. for corrections, which can hinder an employer’s chances of securing an employee. An employer who lacks eVerify can be disqualified from some programs that allow optional practical training from being extended. There are pros and cons to signing up for eVerify.

The U.S.C.I.S. expects all employers to know and enforce these laws. The U.S.C.I.S. no longer provides employer training. However, Congress has recently provided additional funds for the enforcement of these laws through the use of interior D.H.S. Officials.

Note that it is also possible for employers to be fined for refusing to accept valid U.S.C.I.S. documents. These laws, again, were modified in September of 1996 to make it easier for employers.

Parents may also sponsor an adopted child who is immigrating to the U.S.

What Happens If I Don’t Meet Income Requirements?

A minimum income must be met to sponsor someone for a green card in the United States. This is currently a minimum of 125 percent of the Federal poverty level or 100 percent of the poverty level for active-duty military members. For those who do not meet the minimum income requirements, there is still hope to sponsor another person for lawful permanent residence.

When the financial requirements are not met through income, the individual’s assets may be considered when determining their eligibility for financial sponsorship. The assets could include savings accounts, real property, stocks, and bonds. You may also submit with a joint sponsor who accepts legal responsibility for you and your family member.

The I-751 is used for conditional green card holders to remove their residency conditions. What Are Some Common Reasons for the Denial of Form I-751?

What is a Conditional Green Card?

Conditional green cards grant the same rights as a permanent green card but expire after the required period unless the applicant gets their status reapproved. Temporary green cards are usually awarded to people who marry U.S. citizens. The idea is that the marriage must be a marriage based upon love and mutual moral respect. This legal phrase has been mistranslated and can create permanent disqualification.

If your conditional green card expires, you could be subject to deportation. However, the USCIS may still accept your petition to remove the conditions from your green card. Please speak with a lawyer immediately to help remove the conditions from your temporary green card.

How Can I Get the Condition Removed from My Green Card?

You may have the conditions removed from your temporary green card by successfully filing the I-751 with your spouse if you are still married.
